Rule 4A
Registration of land exempted until registration
(1) According to the Land Survey Act, 2019, if there is an exemption until the registration of the land with a survey map, the concerned land owner who wants to register such land shall submit an application to the concerned land office within the period specified by the Government of Nepal by publishing a notice in the Nepal Gazette and attaching the following documents: –
(a) Proof of previous registration of land,
(b) Certificate or proof of payment of land tax,
(c) 7 No. related to land reform as far as available. form,
(d) Other evidence required.
(2) If an application is received in accordance with sub-rule (1), the land office shall post a notice at the place where the land is located or in a public place so that everyone can see it, that if anyone has a claim regarding that land, they should come to file a complaint within thirty-five days. Such notice should be published in Gorkha Patra in case of Kathmandu Valley and in local newspapers as far as possible in case of districts outside Kathmandu Valley.
(3) After the expiry of the deadline for filing a complaint according to sub-rule (2), if necessary, the land office can prepare a report to show the real status of the land, including the concerned village development committee or the municipality, or get the land acquired by keeping the rights of the land.
(4) When taking action regarding land registration in accordance with this rule, the Land Office shall obtain the consent of the concerned Forest Office and the concerned Land Conservation Office in relation to the land where the river has risen, in relation to the land designated as forest buten, forest, bush or other similar practices related to forestry.
(5) After completing the process as per sub-rule (2), (3) or (4), the document with the application received by the customs office, Rule 4B. It has to be submitted to the said committee and if such committee recommends to register the said land, then the land office can register the said land in the name of the concerned person.
